Obtained a defense jury verdict on behalf of a title attorney against purchaser of real estate who claimed a defective title search had cost her over $600,000 in consequential damages when she could not move into the house.  Jury assigned 100% liability for the damages on the closing attorney who had been made aware of problems with the title.
Forced plaintiff to dismiss remainder of the case prior to the conclusion of trial brought by law firm’s former employee alleging violation of the Racketeer Influenced and Corrupt Organizations (RICO) Act, fraud, and tortious interference with contractual rights because she was fired for threatening to reveal the law firm’s alleged mishandling of title insurance premiums.  RICO claims were disposed of on Motion to Dismiss.
Summary judgment affirmed on appeal in a case where plaintiff sued former attorney for legal malpractice, fraud and breach of fiduciary duty alleging that the lawyer misrepresented his expertise in trust and estate planning and overcharged the client for work.
Summary judgment for the defense affirmed by the 11th Circuit Court of Appeals in a case alleging legal malpractice, fraud, RICO, and other claims in connection with an attorney’s representation of nightclub owner in tax evasion cases with the IRS and the Georgia Department of Revenue.  The court ruled that there was no evidence that the attorney had overcharged the client, or, as alleged, misrepresented his expertise and his ability to defeat the government’s tax claims.
Obtained summary judgment on claims against major Atlanta law firm for legal malpractice and securities fraud in a case stemming from actions brought by doctors who sold a privately held information technology business to a publicly traded company in exchange for unregistered stock in the public company.  The district court granted summary judgment holding that plaintiffs had not met the threshold requirements for proving fraud and that the malpractice claims failed because plaintiffs and defendant had no attorney/client relationship under Georgia law.
Summary judgment affirmed in an action for specific performance of a real estate contract.  Represented the plaintiff in the case at the request of the insurance carrier for the law firm that had closed the deal and was accused of failing to obtain proper documentations from defendant.  Court ruled that the closing documents were sufficient to require execution of a particular covenant, and ordered that defendants execute the covenant based on their actions at the closing.
Summary judgment for real estate law firm in a case alleging legal malpractice, fraud, and breach of fiduciary duty.  Court granted summary judgment on grounds that the plaintiff admitted during
his deposition that he received everything he had bargained for in the transactions and could not have been damaged even if his allegations were believed.
Summary judgment for law firm in legal malpractice case arising out of a divorce action.
Summary judgment for law firm on claims for breach of fiduciary duty and malpractice stemming from the representation of divorced parents in a wrongful death lawsuit over the life of their adult son.
