Upper Chattahoochee Riverkeeper, Inc., et al. v. City of Atlanta Represented group of environmental organizations, private property owners, and city and county governments in suit against City of Atlanta for the discharge of pollutants into the Chattahoochee River. Obtained summary judgment on the City's liability for violations, and thereafter negotiated consent decree requiring extensive improvements to the City's sewage treatment system.
Georgia Environmental Project, et al. v. City of Atlanta Represented environmental organizations against City of Atlanta for thousands of violations of Clean Water Act. Obtained summary judgment and thereafter negotiated consent decree for improvements to City's sewer system.
Paper Recycling, Inc. v. Amoco Oil Company Represented plaintiff in one of the first cases in the U.S. to establish the right to bring citizen-suit under RCRA for petroleum leaks from underground storage tanks and lines.
Thomas W. Culbertson, et al. v. Coats American, Inc. Represented property owners living downstream from a creek into which toxins are discharged by thread and dye manufacturing plant. Obtained summary for years of permit violations, establishing an important national precedent on several issues under the Clean Water Act, and negotiated court order requiring clean-up of creek after 50 years of contamination.
Georgia Environmental Organization, et al. v. City of Augusta Represented environmental organization and local residents in Clean Water Act suit against the City of Augusta for pollution of Savannah River. Obtained summary judgment for years of permit violations and negotiated court order requiring extensive improvements to City's sewage treatment system.
Atlantic States Legal Foundation v. Tyson Foods, Inc. Represented environmental organization in case of national significance establishing the right to civil penalties and other relief under the Clean Water Act.
Mildred Pipkin, et al. v. Colonial Motor Freight Lines, Inc., et al. Represented approximately 150 property owners whose private water wells were contaminated by leaks from a nearby truck stop.
Louise Brusher, et al. v. Alternate Energy Resources, Inc. Represented approximately 50 property owners whose groundwater and wells were contaminated by discharges from a solvent recycling plant.
Alice Massa, et al. v. Peabody Coal Company Represented approximately 100 property owners whose homes were damaged by blasting, dust and noise from a Peabody Coal Company surface mine. Obtained injunction against surface mining operation.
McCutchanville United Methodist Church, et al. v. Amax Coal Company Represented approximately 100 property owners whose homes were impacted by blasting from Amax Coal Company surface mine.
Peggy Medlin, et al. v. Koppers Company, Inc. Represented family whose property and pond were contaminated by dioxin and other chemicals from a nearby wood treatment plant.
East West Connector, Cobb County, Georgia Represented the owner of a large tract of historic and commercially valuable property, which was proposed to be condemned for a road project. Issues included rights of condemnation, compliance with Clean Water Act Section 404, Natural Historic Preservation Act, and National Environmental Policy Act. Negotiated settlement with County allowing property owner to retain and protect valuable portions of property.
Grace Anderson, et al. v. Fieldale Farms Corporation Represented 47 families in case against poultry processor arising from offensive odors in the community.
Marshall Charping, et al. v. Colonial Pipeline Company Represented seven families in case against pipeline company arising from leaks of petroleum into the groundwater. Included citizen-suit claims under RCRA and common law claims.
Johnny P. Kinley, et al. v. Colonial Pipeline Company Represented family in case against pipeline company arising from leaks of petroleum into the groundwater.
City of Griffin, Georgia Regional Reservoir Represented owners of 1,200 acre farm near Flint River in opposing and preventing a regional reservoir, which would have rendered hundreds of acres of farm unusable.
Joyce Skaggs, et al. v. MDK Corporation Represented property owner against owner of convenience store/gas station arising from leak of petroleum, which contaminated groundwater.
Marvin D. Kerr, et al. v. Morgan Oil Company, et al. Represented property owner against owner of convenience store/gas station arising from leak of petroleum which contaminated groundwater.
Upper Chattahoochee Riverkeeper Fund, Inc. v. Environmental Protection Division, Fulton County School Board Represented environmental organization in preventing school board from construction activities in a stream buffer.
Charles Elam, et al. v. Colonial Pipeline Company Represented property owners in suit against pipeline company arising from leak of petroleum.
George Mulling, et al. v. Courtyard Management Company, et al. Represented property owners in Cobb County whose lake was damaged by stormwater runoff, silt and sediment from up-gradient construction.
Bishop Lake Association Represented homeowners association in Cobb County whose lake was damaged by stormwater runoff, silt and sediment from up-gradient construction.
